Environment and Climate Change Canada Enforcement has laid five charges against Teck Coal Limited for violating the Fisheries Act.
The specific charges against the company are for breaking subsection 36(3) of the act, which prohibits the dumping of harmful substances into waterways frequented by fish or into a place where the substance may get into those waters.
Federal officials said the charges were laid on Wednesday, following an investigation that began on March 7, 2023.
Enforcement officers were looking into allegations of harmful deposits into Dry Creek on Teck Coal Limited’s Line Creek Operations Mine and the adjacent Fording River.
According to the federal government, waste rock can let off harmful substances, such as high concentrations of selenium, into the environment when exposed to water.
Elk Valley Resources (EVR), which split off from Teck last year, will take financial responsibility for these charges, if the company is found guilty.
“These charges were laid against the Elk Valley Resources business, which will be liable for any penalties payable, including following Glencore’s acquisition of a 77% interest,” said a written statement from EVR.
“We will not comment further on ongoing legal matters, but will honor the commitments made under the ICA and note that EVR has made significant progress in advancing the Elk Valley Water Quality Plan and will continue these efforts.”
Charges have not been approved yet, and Environment Canada officials said those charged under Canadian law are considered innocent until proven guilty.
